1. Scope of Terms & Website Content
This website provides general information regarding our home building, design, and construction services across Western Australia Abode Homes WA. 2. Quotes & Formal Building Contracts (Sole Reliance)
  • Pre-Contractual Estimates & Quotations: Any quotation, proposal, estimate, or preliminary agreement provided by Abode Homes WA is valid for the period stated within that specific document and is subject to site survey, engineering, local council approvals, and final plan specifications Master Builders WA.
  • Sole Reliance on Final Executed Contract: Upon the execution of a formal written residential building contract between you (the Client) and Abode Homes WA, that executed contract shall supersede all prior quotes, proposals, representations, promises, floor plans, or verbal statements.
  • Contractual Terms: All terms governing the scope of works, project fulfillment, final contract price, progress payment stages, variations, timeframes, and site access will be solely governed and relied upon as specified in the signed building contract Housing Industry Association.
 
 
3. Pricing & Progress Payments
  • Fixed Price & Statutory Controls: Building contract pricing and progress payment schedules strictly comply with the Home Building Contracts Act 1991 (WA) Building and Energy WA.
  • Deposits: Statutory deposits prior to construction commencement will not exceed the maximum allowed under Western Australian legislation (6.5% of the contract value) Building and Energy WA.
  • Progress Payment Schedule: Progress stage claims (e.g., Slab Down, Frame, Roof Cover, Plate Height, Lock-Up, Practical Completion) represent work performed and materials supplied in direct accordance with the schedule set out in your formal contract Building and Energy WA.
  • Variations: Any variations to price, scope, or finishes requested after signing must be agreed upon in writing and executed by both parties prior to work commencing Houspect WA.
 
 
4. Insurances & Statutory Compliance
Abode Homes WA operates in strict accordance with Western Australian building standards and industry associations Building and Energy WA:
  • Master Builders Association Alignment: All construction contracts, safety standards, and insurance practices are administered in association with the guidelines and standard contracts endorsed by the Master Builders Association (MBA WA) Master Builders WA.
  • Home Indemnity Insurance (HII): Where required by the Home Building Contracts Act 1991 (WA), Abode Homes WA maintains valid Home Indemnity Insurance covering residential construction projects Building and Energy WA. Proof of insurance policy will be issued prior to the demand of any deposit or commencement of works on site.
  • Public Liability & Construction Works Insurance: We maintain comprehensive Public Liability Insurance and Works Insurance policies under Western Australian legal requirements throughout the construction process.
 
 
5. Intellectual Property
All custom home designs, plans, floor layouts, specifications, graphics, and written content produced by or hosted on behalf of Abode Homes WA remain the intellectual property of Abode Constructions WA Pty Ltd Master Builders WA. They may not be reproduced, copied, modified, or transferred to third parties or other builders without prior written consent.
 
 
6. Australian Consumer Law (ACL)
Nothing in these Terms of Service excludes, restricts, or modifies any rights, guarantees, or remedies available to consumers under the Australian Consumer Law (ACL) contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth).
 
 
7. Governing Law
These terms, as well as any building agreements entered into with Abode Homes WA, are governed by and construed in accordance with the laws of Western Australia. You agree to submit to the jurisdiction of the courts of Western Australia.
